Waste Collection Ruislip Terms and Conditions

These Terms and Conditions set out the basis on which we provide waste collection services in Ruislip and surrounding areas. By booking a service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Service means any waste collection, removal, loading, transportation, recycling, clearance or related service provided by us.

Customer means the person, business or organisation who books or pays for the Service.

Waste means the materials, rubbish, junk, household items, commercial waste or other items that the Customer requests us to collect, subject to these Terms and Conditions and relevant legislation.

Contract means the agreement between the Customer and us comprising these Terms and Conditions and the booking confirmation.

2. Scope of Services

We provide waste collection services for domestic and commercial customers in Ruislip and nearby locations. Our services may include one-off collections, regular collections, bulky waste removal and waste recycling, subject to availability.

The exact scope of the Service, including the type and estimated volume of waste, collection address, date, time window and any special instructions, will be set out in the booking confirmation issued to the Customer.

We reserve the right to refuse to collect any waste that is not accurately described at the time of booking, that is hazardous, illegal, unsafe to handle, or exceeds the agreed volume or weight limits.

3. Booking Process

3.1 A booking may be made by telephone, email or through our online booking channels where available. The Customer must provide accurate information, including:

a. Full name and contact details of the Customer

b. Collection address and access details

c. Description and approximate quantity of waste

d. Preferred date and time window for collection

e. Any relevant parking or access restrictions.

3.2 When we receive a booking request, we will provide a quotation based on the information supplied. This quotation may be verbal or written and will normally include an estimate of charges, any call-out fees and any applicable surcharges.

3.3 A Contract is formed only when the Customer accepts the quotation and we issue a booking confirmation. We reserve the right to refuse any booking at our sole discretion.

3.4 The Customer is responsible for ensuring that all information provided at the time of booking is correct. Additional charges may apply if the actual waste, location or conditions differ significantly from the information supplied.

4. Access and Customer Obligations

4.1 The Customer must ensure that our staff and vehicles have safe and reasonable access to the collection point at the agreed time. This includes arranging any permits for parking if required, ensuring gates are unlocked and providing any entry codes in advance.

4.2 The waste must be accessible, clearly separated from items that are not to be removed, and presented in a reasonably safe condition for handling. We may refuse to handle waste that is contaminated, incorrectly stored or unsafe to move.

4.3 The Customer warrants that they either own the waste and items to be collected or have full authority to arrange their removal.

4.4 The Customer must inform us in advance of any known hazards, including sharp objects, heavy items, contaminated materials, or areas with restricted access.

5. Pricing and Payment Terms

5.1 Our charges are based on factors including the type and volume of waste, access conditions, labour required, disposal costs and any additional services requested.

5.2 Prices quoted are typically exclusive of VAT unless otherwise stated. Any applicable VAT will be added to the final invoice in accordance with UK law.

5.3 We may require full or partial payment in advance to confirm a booking. Where payment on completion is agreed, payment becomes due immediately upon completion of the Service.

5.4 Accepted payment methods will be notified to the Customer at the time of booking and may include card payment, bank transfer or cash, subject to our current policies.

5.5 If the actual volume or nature of waste exceeds that set out in the booking confirmation, we may:

a. Recalculate the price and seek the Customer's approval for additional charges before proceeding, or

b. Decline to collect the excess waste.

5.6 If payment is not made when due, we reserve the right to charge interest on overdue sums at the statutory rate permitted under UK law, as well as reasonable costs of recovering the debt.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting us directly. Cancellations or changes must be communicated during our normal office hours.

6.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, any pre-paid amount may be refunded or credited, less any reasonable administrative costs, in accordance with our refund policy at the time.

6.3 If the Customer cancels a booking within 24 hours of the scheduled collection time, we reserve the right to charge a cancellation fee up to the full quoted price, to cover allocated staff, vehicle and disposal costs.

6.4 If our team arrives at the collection address at the agreed time and is unable to access the premises or waste due to reasons within the Customer's control, this may be treated as a cancellation within 24 hours and a call-out or cancellation fee may be charged.

6.5 We will use reasonable efforts to accommodate any requested changes to the booking, such as changes to time, date or waste volume, but we cannot guarantee availability.

7. Service Delivery and Timeframes

7.1 Any collection date or time window given is an estimate only. While we aim to provide timely waste collection in Ruislip and nearby areas, delays may occur due to traffic, weather, access issues, vehicle breakdowns or other circumstances beyond our control.

7.2 If we anticipate a significant delay, we will try to contact the Customer using the details provided at the time of booking to agree an alternative time or date.

7.3 We are not liable for any loss, costs or expenses incurred by the Customer arising from a delay or failure to perform the Service where such delay or failure is caused by events beyond our reasonable control.

8. Waste Types and Regulations

8.1 We operate in compliance with applicable UK waste management legislation and regulations. The Customer agrees not to present waste that is unlawful for us to carry, store or dispose of.

8.2 Unless expressly agreed in writing, our Service does not include collection of any hazardous or special waste, including but not limited to:

a. Asbestos or materials containing asbestos

b. Clinical or medical waste

c. Chemicals, solvents, oils or paints

d. Gas bottles, fuel tanks or pressurised containers

e. Explosives, firearms or ammunition

f. Radioactive materials.

8.3 If prohibited or hazardous materials are discovered among the waste, we may refuse to collect them, require the Customer to remove them, or apply additional charges for safe handling and disposal where we are lawfully able to do so.

8.4 The Customer is responsible for ensuring that any confidential or sensitive items, such as personal documents or data, are removed or securely destroyed before collection. We accept no liability for any loss of confidential information contained within waste that we lawfully remove.

8.5 We aim to recycle or recover as much waste as is reasonably practicable, but we provide no guarantee as to the proportion of waste that will be recycled versus sent for energy recovery or disposal, as this depends on material types and local facilities.

9. Title and Responsibility for Waste

9.1 Title to the waste transfers to us upon loading into our vehicle, provided that the Customer has authority to dispose of it. Until that point, the waste remains the responsibility and property of the Customer.

9.2 Following collection, we are responsible for transporting and disposing of the waste in accordance with applicable law and our duty of care as a licensed waste carrier, where applicable.

9.3 We may sort, process, recycle, reuse or dispose of the waste at our discretion, provided such activities comply with relevant legislation and regulations.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.

10.2 Subject to clause 10.1, we are not liable for any indirect, consequential or economic loss, including loss of profits, loss of business, loss of data or loss of opportunity, arising from or in connection with the Service or these Terms and Conditions.

10.3 Our total liability to the Customer for any loss or damage arising out of or in connection with the Contract, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by the Customer for the specific Service giving rise to the claim.

10.4 The Customer must notify us in writing of any damage or issues arising from the Service as soon as reasonably practicable and in any event within seven days of the collection date, providing full details and evidence where possible.

10.5 We will take reasonable care when moving items or waste from the Customer's premises. However, we are not liable for pre-existing damage, wear and tear, or defects in structures, fixtures or items that are moved as part of the collection.

11. Customer Indemnity

The Customer agrees to indemnify and keep us indemnified against any losses, damages, claims, costs and expenses arising from:

a. The Customer's breach of these Terms and Conditions

b. The Customer's failure to comply with waste regulations or provide accurate information about the waste

c. Any claim by a third party relating to the ownership of items collected or the Customer's lack of authority to dispose of them.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Service, they should contact us as soon as possible, providing details of the issue and any supporting information.

12.2 We will investigate complaints in a timely and fair manner, and may ask for additional information or evidence. We aim to respond with our findings and, where appropriate, a proposed resolution.

12.3 Nothing in this section affects the Customer's statutory rights under UK consumer law, where applicable.

13. Data Protection and Privacy

13.1 We collect and process personal data such as names, contact details and service information for the purpose of providing waste collection services, administering bookings and complying with our legal obligations.

13.2 We will handle personal data in accordance with applicable UK data protection legislation and our internal policies on privacy and data security.

13.3 The Customer is responsible for ensuring that any personal data they provide to us is accurate and up to date.

14. Changes to Terms and Conditions

14.1 We may update these Terms and Conditions from time to time to reflect changes in law, industry practice or our operations.

14.2 The version of the Terms and Conditions in force at the time of the booking will apply to that Contract, unless a change is required by law or we agree otherwise with the Customer.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions and any Contract between us and the Customer are governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, including any non-contractual disputes or claims.

16. General Provisions

16.1 If any provision of these Terms and Conditions is held by a court to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.

16.3 The Customer may not assign or transfer their rights or obligations under the Contract without our prior written consent. We may assign or subcontract our rights and obligations under the Contract provided that this does not materially affect the Service.

16.4 These Terms and Conditions, together with the booking confirmation, constitute the entire agreement between the Customer and us in relation to the Service and supersede any prior understandings or representations, whether oral or written.
